These Terms of Service (the “Terms”) govern your access to and use of Homam.AI and its websites, applications, data, and related services (the “Service”). The Service is operated by Growth Gate for Smart Solutions LLC, a company registered in the Sultanate of Oman (“Homam”, “we”, or “us”). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a company or other organization, you confirm that you are authorized to accept these Terms on its behalf, and “you” includes that organization.
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. You must provide accurate account information, keep your login credentials confidential, and not share them with or allow your account to be used by anyone other than users authorized through your account in the Service. You are responsible for activity under your account and must notify us promptly of any unauthorized use. If you use the Service on behalf of an organization, that organization is responsible for the acts and omissions of every user it authorizes.
You must use the Service lawfully and in accordance with these Terms. You may not use automated agents, bots, scripts, or other automated means, including AI-powered agents, to access, query, crawl, scrape, collect, or extract information from the Service without Homam’s prior written permission, except through features that Homam designs and offers for that purpose. This restriction does not prohibit ordinary browsing by a person who may use an AI-assisted browser feature while personally navigating the Service. You also may not attempt to gain unauthorized access to the Service, circumvent its security measures, usage limits, or access controls, interfere with its operation, or reverse engineer it except where the law expressly permits this.
You may not upload or submit content that is unlawful, infringes the rights of others, or contains viruses or other malicious code. You may not use the Service or any output obtained from it to train or develop an artificial intelligence or machine learning model, or to build a product or service that competes with the Service.
The Service, including its software, design, trademarks, and the way information is collected, organized, classified, summarized, analyzed, and presented in it, belongs to Homam or its licensors and is protected under the laws of the Sultanate of Oman. Subject to these Terms and any applicable subscription, we grant you a limited, non-exclusive, non-transferable right to use the Service for your own internal business purposes.
Without Homam’s prior written consent, you may not use information or materials obtained through the Service to develop, provide, market, or operate a commercial product or service, or reproduce, redistribute, resell, or otherwise commercially exploit such information or materials. Underlying tender information published by government entities or other third parties remains subject to the rights of its owners; these Terms do not transfer ownership of it to you or to us and do not limit rights that cannot lawfully be restricted.
Tender information in the Service is gathered from government portals and other third-party sources and may be incomplete, delayed, changed, or withdrawn by its source. Summaries, analyses, recommendations, and other content generated with artificial intelligence may contain errors, and similar content may be provided to other users. The Service is a research aid, not legal, financial, or procurement advice. You must review AI-generated content with human judgment before relying on it, and you are responsible for verifying information against the official source before preparing or submitting a bid. Homam is not a party to any tender, does not guarantee that any tender will be awarded to you, and is not responsible for a tender’s requirements, deadlines, or outcome.
You own the documents, profiles, business interests, and other content you submit to the Service (“Your Data”). You grant Homam a licence to host, process, and display Your Data as needed to provide the Service to you and as described in these Terms. We may de-identify and aggregate Your Data, after removing personal data, and use it to improve and train the artificial intelligence features of the Service. You confirm that you have the rights needed to submit Your Data and to permit us to process it as described in these Terms.
Each party may receive non-public business, technical, or financial information from the other. For you, this includes Your Data. For Homam, this includes non-public information about the features, performance, and operation of the Service. Each party will protect the other’s non-public information with reasonable care and will not use or disclose it except to provide or use the Service, as permitted by these Terms, or where the law requires it. These obligations do not apply to information that is or becomes publicly available without breach of these Terms, was already known to the receiving party, or was independently developed without using the other party’s information.
We maintain reasonable technical and organizational measures to protect Your Data against unauthorized access, loss, and disclosure. We use third-party hosting and AI providers to operate the Service, under agreements that protect your data.
We process personal data in accordance with our Privacy Policy and the Personal Data Protection Law of the Sultanate of Oman issued by Royal Decree No. 6/2022.
Paid features are provided according to the plan, price, duration, and usage limits presented to you at the time of purchase. Prices are subject to applicable taxes, including value added tax, where required by law. Payments are processed by third-party payment providers, and your use of them may be subject to their terms.
Subscriptions renew automatically for the same period unless you cancel before the renewal date. You may cancel at any time from your account settings, and cancellation takes effect at the end of the period you have paid for. Except where the law requires otherwise, fees are not refundable for unused time. We may change our prices by giving you at least thirty days’ notice, and the new price applies from your next renewal. If a payment fails or is overdue, we may suspend access to paid features after notifying you until payment is received.
We offer a free trial of fourteen days, limited to one trial per organization. When the trial ends, your subscription begins and you are charged the applicable fee unless you cancel before the trial ends. We may change or withdraw trial offers at any time.
We may change, add, or discontinue features of the Service. If a change materially reduces the functionality of a paid plan, we will give you at least thirty days’ notice.
You may stop using the Service at any time. We may suspend or terminate your account and access to the Service if we reasonably believe that you have breached these Terms, if your payment is overdue, if your use poses a security risk to the Service or other users, or if the law requires us to do so. To the extent permitted by applicable law, fees paid for the affected subscription period are non-refundable when termination results from a breach. This does not limit any non-waivable rights you may have under applicable law.
You may export Your Data from the Service before your account is closed. We may delete Your Data thirty days after your account is terminated. Sections that by their nature should continue after termination, including those on intellectual property, confidentiality, commercial use, liability, indemnity, remedies, and governing law, survive termination.
To the extent permitted by applicable law, the Service is provided “as is” and “as available”, and we do not guarantee that it will be uninterrupted, error-free, or that any information in it is accurate or complete. Homam is not liable for indirect or consequential losses, including lost profits, lost business opportunities, or a missed or unsuccessful tender. Our total liability arising from the Service is limited to the fees you paid to Homam for the Service during the twelve months before the event giving rise to the claim. These limitations do not apply to liability for fraud or gross negligence, or to any liability that cannot be limited under the laws of the Sultanate of Oman.
You will indemnify Homam against claims, losses, and reasonable costs brought by a third party that arise from Your Data, any bid or tender you pursue, or your breach of these Terms.
You acknowledge that unauthorized extraction of information from the Service, or unauthorized commercial use of information or materials obtained through it, would cause Homam harm that monetary compensation alone cannot remedy. In addition to any other remedy available under applicable law, Homam may seek an injunction or similar relief from any competent court to stop such use.
These Terms are governed by the laws of the Sultanate of Oman. The parties will first try to resolve any dispute amicably by contacting each other in writing. If a dispute is not resolved within thirty days, it will be referred to the competent courts in Muscat, Sultanate of Oman.
These Terms, together with any plan you purchase, form the entire agreement between you and Homam regarding the Service and replace any earlier agreement on the same subject. If any part of these Terms is found unenforceable, that part will be limited or removed to the minimum extent necessary and the rest will remain in effect. You may not transfer your rights or obligations under these Terms without our written consent; Homam may transfer them without your consent in connection with a merger, acquisition, sale of assets, or corporate reorganization. If either party does not enforce a provision of these Terms, it may still enforce it later. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, except for payment obligations.
These Terms are published in English and Arabic. If there is any inconsistency between the two versions, the English version prevails.
We may send notices to the email address on your account or through the Service. We may update these Terms by publishing a revised version. If a change is material, we will ask account holders to accept the revised version before continuing to use authenticated parts of the Service; for other changes, we will notify you and your continued use of the Service means you accept them.
